Terms and Conditions of Sale - January 2010
DefinitionsThe “Customer” refers to any person, persons, firm or company who requests or receives a quotation, places an order or purchases any products from the company, and includes the servants, agents or employees or sub contractors of any such organisations.
The “Company” refers to Peter Smerdon, having their registered office at 118a Priory Road, Lower Compton, Plymouth Devon PL3 5EX.
Application of Definitions All goods are sold, and contracts concluded, subject to these conditions. No variation of the contract or these conditions shall be of any effect unless agreed by the Company in writing and dated after the date of this release of these terms.
Orders Orders may be placed by phone, fax, email, web, or in person at our registered address. The Company reserves the right to refuse to supply goods to any third party without reason. Customers may cancel orders provided this is done in writing prior to despatch.
Delivery Every endeavor will be made to deliver the goods as promptly as possible but the Company accepts no liability in the event of unavoidable delay however caused. Complaints regarding non-delivery, shortages or defects in goods supplied, can only be considered if notified within 5 days of the invoice date. In the absence of claims being made within these terms, the goods shall be deemed to have been received complete and in a satisfactory condition, and the risk in them transferred to the customer.
Prices The Company endeavors to ensure that prices shown on our website are accurate but as such are not deemed binding. Invoices will be submitted at prices ruling at the date of despatch.
Illustrations or descriptions of colour, size, features etc should be considered only for guidance. Constant improvements or changes of supplier may affect product specifications.
Returns No goods may be returned without the Company’s prior authorisation and must quote our returns number.
